Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Spark Wave, LLC, a Delaware limited liability company ("we," "us," "our"), governing your use of The 12 Levers Bot at bot.12leversbook.com (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using it, you confirm that you meet these requirements.

2. The Service

The Service is an AI chatbot that helps you identify and apply self-help and psychology techniques from the book The 12 Levers by Spencer Greenberg and Jeremy Stevenson. It is an educational and self-improvement tool.

3. Not Therapy, Medical Advice, or a Crisis Service

The Service is not therapy, counseling, medical, or mental-health care, and it does not create any professional or therapeutic relationship. It does not diagnose, treat, or prevent any condition, and it is not a substitute for advice from a qualified professional. If you are in crisis or thinking about harming yourself or others, do not use the Service — contact your local emergency services immediately or a crisis hotline (in the U.S., call or text 988). Always seek the advice of a qualified professional for medical or mental-health concerns.

4. Accounts and Your Responsibilities

You are responsible for the activity on your account, for keeping access to your email secure, and for the accuracy of the information you provide. Notify us promptly of any unauthorized use.

5. Acceptable Use

You agree not to:

  • use the Service for anything unlawful, harmful, or abusive;
  • attempt to access other users' data or our systems without authorization;
  • reverse engineer, scrape, overload, or circumvent usage limits or security measures;
  • resell or provide access to the Service, or use it to build a competing product;
  • submit content that infringes others' rights or that you have no right to share;
  • misuse the Service to generate harmful, deceptive, or illegal content;
  • attempt to extract, uncover, or reverse engineer the bot's prompts, system messages, or other underlying instructions or models; or
  • use the Service for any purpose other than its intended purpose.

6. Subscriptions, Trials, Billing, and Cancellation

  • Free trials. We may offer free-access periods (for example, via pre-order or newsletter links).
  • Paid plans. Paid subscriptions are offered at the prices and billing periods stated at checkout. Payments are processed by Stripe; by subscribing you also agree to Stripe's applicable terms.
  • Auto-renewal. Paid subscriptions automatically renew at the end of each billing term at the then-current price until you cancel.
  • Cancellation. You may cancel at any time, effective at the end of the current billing term; you keep access until then.
  • Refunds. Except where required by law, fees are non-refundable and we do not provide prorated refunds for partial terms.
  • Changes. We may change pricing or plans on a going-forward basis with reasonable notice.

7. Intellectual Property

The Service, the book content, software, and all related materials are owned by Spencer Greenberg and Jeremy Stevenson or their licensors and are protected by law. We grant you a limited, personal, non-transferable, revocable license to use the Service for your own non-commercial purposes.

You keep ownership of the messages you submit ("User Content"). You grant us a worldwide, royalty-free license to host, process, and use your User Content to operate, maintain, and improve the Service, including performing anonymous and aggregated analysis of messages to fix issues and enhance quality. You represent that you have the rights to submit your User Content.

8. AI Output

The bot's responses are generated by AI and may be inaccurate, incomplete, or not suitable for your situation. Responses are not professional advice. You are responsible for how you use any information the bot provides and should use your own judgment.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the fullest extent permitted by law, Spark Wave, LLC, Spencer Greenberg, and Jeremy Stevenson will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Their total combined liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or USD $100.

11. Indemnification

You agree to indemnify and hold harmless Spark Wave, LLC, Spencer Greenberg, and Jeremy Stevenson, and their respective officers, employees, and agents, from claims, damages, and expenses (including reasonable legal fees) arising out of your use of the Service or your breach of these Terms.

12. Termination

We may suspend or terminate your access at any time for violation of these Terms or to protect the Service or other users. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.

13. Changes to These Terms

We may update these Terms from time to time. We will post the updated version with a new "Last updated" date, and material changes may be communicated by email. Continued use after changes take effect means you accept them.

14. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the state and federal courts located in New York.
